Wal-Mart Worker Dies on a Very Black Friday

A 34-year-old temporary holiday worker died under a stampede of 2,000 discount hungry Wal-Mart shoppers yesterday. Witnesses described crowds at the Long Island, NY, Wal-Mart as savages; shoppers busted down doors and cut each other in line. Other shoppers, including a pregnant woman, were rushed to the hospital.

Not every store saw a surge, violent or not, in shopping. In anticipation of lower than usual performance, retailers took a hit in the stock market, as company shares dipped on Friday. But regardless of tough economic times, foreign shoppers vacationing in the US came out in significant numbers to take advantage of bargains compounded by a favorable exchange rate. Some speculate that tourists could save the holiday shopping season this year.

New York Taxis Won't Go Green Under City's Watch

New York City's plan to turn its whole fleet of yellow cabs green by 2012 got the red light this week from a federal judge, who ruled that regulation of fuel emissions standards falls under federal authority.

The plan called for every new taxi to have a standard of least 30 miles per gallon — a benchmark met by hybrid and clean diesel cars.

US District Judge Paul Crotty said enforcing the new regulations now would be costly to the taxi industry, which prompted Mayor Michael Bloomberg to release a statement saying the city is considering an appeal.

Green taxis are a focal point of Bloomberg's environmental plan. There are currently about 1,400 hybrid taxis in the city.

Drunk drivers are losing part of their 15 minutes of shame after a judge's ruling deemed that New York's Nassau County had been violating due process by posting the mug shots of DWI suspects on its Internet "Wall of Shame." The county began posting the mug shots of DWI arrests on Memorial Day, and has since been sued by one woman who was pictured. She said the online gallery was unconstitutional as it was posted before her trial. The county attorney says the mugshots are public documents and are just being given a public airing. The judge however points to the power of the web, saying that posting the photos to the Internet creates "limitless and eternal notoriety." However, the county executive and proponent of the "Wall" says of the program, "The objective of what we're trying to do here is to change the culture that exists related to drunk driving, that it's not just a socially acceptable crime."Since the Memorial Day start of the program, more than 1,400 drunk drivers have been pictured, and drunk driving arrests are up 6 percent over the previous year.

Folks trekking out to Coney Island are looking for a little summer diversion involving water — but the newest attraction to grace the boardwalk takes that expectation and adds a political message. Called the "Waterboard Thrill Ride," the sideshow is decorated with SpongeBob, advertises that "it dont [sic] Gitmo better" and charges $1 for a look through a barred window onto what appears to be an interrogation scene.Robots portray a prisoner and an interrogator. After the dollar is paid, the lights come on and the prisoner begins to convulse violently as water is poured on his face. The artist behind the installation says its aim is to provoke people into thinking critically about the technique. He says, "robot waterboarding became a way of exploring the issue without doing any harm. It's putting a unique experience on the table. And it doesn't take a great leap of the imagination to look in there and say: 'That's really what's going on? That's crazy.'" And who doesn't fancy a little torture demo with their corndog?There's a video of the "ride" in action, including reaction from some bystanders, some of whom hadn't heard of waterboarding before. In that sense, is it a decent public service — or does it turn a serious message into a silly sideshow?

YouTube Baby Food Threats Get New York Man Arrested

Anton Dunn, a 42-year-old New Yorker who also goes by the name "Trashman," has ended up in jail after he posted numerous videos claiming that he helped poison millions of Gerber baby food containers. Wearing a black mask, Dunn said that upon his request Gerber employees contaminated the baby food with cyanide, getting him closer to his goal of killing infants.

When authorities apprehended Dunn they found no evidence that he actually did anything to baby food. Now he faces charges of sending threats and falsely claiming to have tampered with a consumer product. He also faces a maximum sentence of five years for each count.

This story reminds me of the possibly-illegal strip joint calling itself a performing arts center as a legal defense — should the law treat a threatening YouTube video as art? Free speech? Terrorism? While it's responsible for law enforcement officials to address disruptive threats, they would have their hands full if they tried to go after all the crazy stuff on the Internet.

UN Fights Global Warming and Suits by Turning Up Thermostat

The UN has announced an "In-house Climate Change Initiative," which will begin by raising building temperatures by five degrees at the UN's headquarters in New York. The thermostat in the Secretariat building will be turned up to 77 degrees, and air conditioning turned off during the weekends.

During the month-long "Cool UN" experiment, engineers will test energy consumption and utility costs. UN Secretary General Ban Ki-Moon has a plan to beat the heat: he's suggesting UN workers ditch their sweaty suits, and wear their national dress to work, a dress code that used to be common practice at the UN.

Critics portray the effort as a token policy, but even if it doesn't stop global warming at least diplomats will relate to their constituents in dress and in body temperature.

Farm Offers Horseback Riding Therapy For Vets with PTSD

A New York farm is offering horseback riding as a form of therapy to veterans suffering from mental and emotional wounds like post-traumatic stress disorder. The farm offers veterans free horseback-riding lessons, as a way for them to relax and take their minds off their memories of war. Participants say the calm helps reduce anxiety.

Seaside Therapeutic Riding says that the horse and human bond is renowned for its healing quality, and that a horse's non-judgmental acceptance allows students, including veterans and disabled adults and children, to learn and to grow. The therapy is popular — the farm currently has a waiting list, and relies on donations to give the experience to more veterans.

The horse riding therapy sounds much more comforting than the Iraq war simulation video game therapy, which calls for prolonged virtual-exposure to the source of the trauma (including smells and sounds). Which idea sounds more promising to you?

Inbox Law and Order: Spam AOL, Get 30 Months In Prison

A New York spam aficionado just got 30 months in jail for spamming AOL subscribers. He must also pay the company $180,000. Too bad nobody ever got locked up for mailing all those AOL CD-ROMs.

The spammer, 27-year-old Adam Vitale, circumvented AOL's spam filter and spammed AOL's 1.2 million subscribers on behalf of a government informant. Vitale, who has also been accused of running a Craigslist prostitution ring, had made a deal with the informant to send out junk emails advertising software in exchange for 50 percent of the software's profits.

I just signed in to my ancient AOL account to do some research and found 94 emails, aka my inbox, I would classify as spam, all received in the last month (see image). So I'm thinking it can't be that hard to crack the filter. Either way, as Vitale received his spamming sentence, the federal judge told him that "spamming is serious criminal conduct." Do you agree? Was a two-and-a-half-year sentence fair?

City hospital officials agreed in court Tuesday to implement reforms at a psychiatric ward where surveillance footage showed a woman falling from her chair, writhing on the floor and dying as workers failed to help for more than an hour. Esmin Green, 49, had been waiting in the emergency room for nearly 24 hours when she toppled from her seat at 5:32 a.m. on June 19, falling face down on the floor. Mayor Michael Bloomberg said he was disgusted by the tape, and that the actions of the hospital staff were unacceptable.

Positive Step? NY Wants to Test Everyone in the Bronx For HIV

Although the rate of AIDS diagnosis is higher in Manhattan, the Bronx has New York's highest AIDS death rate — a figure health officials blame on people not getting tested until it's too late to manage the disease. In order to curb the graveness of an HIV diagnoses, the city has launched a campaign to test everyone in the Bronx.

Starting Friday, if you go to a Bronx hospital for an unrelated ailment, doctors will test you for HIV unless you object. New York state law requires written consent and patient counseling to go along with an HIV test. The Bronx initiative will shorten the 20-minute counseling session to five minutes and offer routine tests at emergency rooms and storefront clinics. Elected officials, health-care providers, and clergy members plan to assist the effort for universal testing.

Punishment vs. Human Rights — Are Prisons Going Soft?

Though I don't know of many prisons guarded by the likes of the two pictured below, with the changes happening to crime and punishment in the US, it might not be long. With one out of every 100 Americans behind bars, and prisons turning criminals out to meet their budgets, the debate between what's a human right, and what liberties need be taken away as punishment is a tricky one. Several states have just come to some conclusions — on the side of rights.

In New York's juvenile detention centers, transgender youth are now allowed to wear whatever gendered-uniform they associate with and be called by whatever name they request, as well as receive access to special housing under a new anti-discrimination policy. The enhanced rights are drawing praise from advocacy groups. A spokesman for Governor Paterson said the policy reflects the state's intent to be "tolerant, responsive and respectful" of gender identity and gender expression issues.

Hawaii and California join New York among the small list of states that have taken steps to afford specific civil rights protection to gay, lesbian, bisexual and transgender youth in juvenile detention. This comes after a 2001 report found that gay, lesbian, bisexual and transgender youth routinely experienced discrimination, harassment and violence in New York's juvenile justice system.

Should States Impose Automatic Term Limits?

An editorial in today's New York Times bashes automatic term limits on political office. The predicament of New York City Mayor Michael Bloomberg demonstrates the discord — voters approve of the job he's doing, but would vote for term limits again if given the choice. So why do voters favor limits that make them give up effective government leaders? The editorial explains that promises of ending gridlock and purging the system of self-serving incumbents attract voters' support. But there is a down side to this automatic house cleaning. Term limits quickly turn leaders into lame ducks, removing their electoral accountability. Also, voters lose their choice to elect provenly capable politicians. In some ways, it distrusts citizens to make a decision in their best interest, assuming that they would not be able to identify a selfish and special-interest-entrenched politician. Was the Sean Bell Verdict Justice Served?

As we reported this morning, the three New York City police officers charged in the 50-bullet shooting death of an unarmed black man, Sean Bell, have just been found innocent of all charges.

In the November 2006 incident Bell, 23, was shot along with two friends after his bachelor party at a strip club. The judge in the case cleared two officers of manslaughter and other charges and a third of reckless endangerment in the death. Following the reading of the verdict this morning, passionate responses on both sides broke out. Some supporters of Bell stormed out of the courtroom, followed by screams in the hallway moments later. The three detectives — Gescard F. Isnora, Michael Oliver, and Marc Cooper — were escorted out of a side doorway, and outside a huge crowd gathered among a throng of police officers.The defendants waived their right to a jury, leaving the decision to the judge. He said in his verdict, “the police response with respect to each defendant was not found to be criminal. The people have not proved beyond a reasonable doubt” that each defendant was not justified in shooting. New York Mayor Michael Bloomberg said: There are no winners in a trial like this. An innocent man lost his life, a bride lost her groom, two daughters lost their father, and a mother and a father lost their son. Judge Cooperman’s responsibility, however, was to decide the case based on the evidence presented in the courtroom. America is a nation of laws, and though not everyone will agree with the verdicts and opinions issued by the courts, we accept their authority. There will be opportunities for peaceful dissent and potentially for further legal recourse — those are the rights we enjoy in a democratic nation. We don’t expect violence or law breaking, nor is there any place for it.

Not Guilty in Bell Case: Three New York City police officers have just been found innocent of all charges in the shooting death of an unarmed black man, Sean Bell, who was killed by 50 bullets on his wedding day. Bell, 23, was shot along with two friends, after a bachelor party at a strip club in November 2006. The case has generated outrage in New York's black community. A New York State Supreme Court judge cleared two officers of manslaughter and other charges and a third of reckless endangerment in the death.

al-Sadr Calls Truce: Shiite cleric Muqtada al-Sadr this morning called for an end to fighting between his militia and Iraqi troops. al-Sadr declared that his threat of an "open war" will be carried out only on US-led foreign forces. al-Sadr urged Iraqi soldiers and policemen "not to support the occupiers in combating your brothers." In other Iraq news, the largest Sunni bloc has just agreed to return to Prime Minister Nuri Kamal al-Maliki’s cabinet after a boycott of almost a year. A recently passed amnesty law and the government’s crackdown on Shiite militias were cited as reasons for the move.
Syria Secret Nuclear Program: The United States has accused North Korea of helping Syria build a nuclear reactor that "was not intended for peaceful purposes." The US released photographs it said linked North Korea to a plutonium-producing reactor under construction in Syria. The accusation was an effort to put pressure on Pyongyang to come clean about proliferating nuclear technology. Though the accusations are not expected to derail international talks aimed at ending the communist state's own nuclear arms program, Japan is concerned saying, "of course, if North Korea was helping Syria's secret. . . nuclear activities, then this is a serious issue."

Chronic Groper Faces Life in Prison

Freddie Johnson has been arrested 53 times for groping women on NYC subway trains. Now, he faces life in prison for his latest arrest, which came only two weeks after his release from prison.

This time, plainclothes officers recognized Freddie from police photos of repeat offenders. They followed him, while he groped a female passenger selected at random.

Gropers often attack in crowded areas, and almost always escape. Apparently, there is not a crossover of offenders that grope, and those that engage in rape or other serious sexual assault. According to a recent survey, 63 percent of respondents reported being sexually harassed in some way on the NYC subway.

Like graffiti — the negative impact of an anonymous grope seems less severe than other crimes; but both subway-prone crimes decrease the overall feeling of security in the community. Plus, unlike graffiti, which everyone sees, groping involves personal violation, not shared with all the other riders.

If Freddie Johnson is intent on re-offending, does New York have no choice but to lock him up forever? Or, should we spend tax money locking up more dangerous offenders, while suffering an occasional grope?

I feel sort of icky writing about this, but I suppose the damage is already done. "Kristen" — the high-end prostitute employed by ex-Governor Eliot Spitzer — has been found. At 22 years old, this young woman is not much older than Spitzer's teenage daughters.

Thank you to the New York Times for telling the story that obviously needed to be told. By telling the story, I mean copying and pasting her MySpace page.

I wonder how Spitzer's teenage daughters feel about seeing pictures of the attractive woman their father paid for sex splashed all over the newspaper and internet. This just highlights the countless victims of Eliot Spitzer and the American obsession with sex scandals. With spurious reporting, comes great responsibility. Check This: The I Heart Philanderers Backlash

Scandal-aficionados recognize the pattern instantly: the story breaks, the news bashes out wall-to-wall coverage, there's an announcement usually with a side of wife, an agonizing period where the man waits to see if his indiscretion will climax or fade, and then the inevitable bail out. Nothing in our culture will nail you faster than sex. So to speak.

But not everyone is so horrified. I'm not. Sure, prostitution is illegal, so Spitzer-gate might be worth a second glance on that front, but as for being an outrage? Nah. A man having sex? And looking for it as many places as he can get it? Hardly a unicorn. I suppose it could even be argued that Spitzer was being responsible using a professional to fulfill his needs. (A well-paid one at that.) Far from being profligate, Spitzer's outlay of thousands might have been a good investment in her silence — if it wasn't for those pesky investigators, it would have been a wad worth shooting. I'm just getting warmed up,

In an announcement moments ago in New York City, Eliot Spitzer resigned saying, "In the past few days I've begun to atone for my private failings," adding, "from those to who much is given, much is expected." He continued, "I sincerely apologize . . . I cannot allow my private failings to disrupt the public's work," concluding, "I am resigning the office of governor . . . effective Monday, March 17. . . thank the public once again for the privilege of service."

In the two days since the story of Spitzer's connection to a prostitution ring broke, details have emerged that suggest, according to law enforcement officials, that Spitzer had spent tens of thousands of dollars on the call-girl service Emperors Club VIP, some putting the figure as high as $80,000.

David Paterson, New York's Lieutenant Governor, will take over. He is legally blind and will be New York State's first African-American governor. When asked for lessons these characteristics had taught him, Paterson replied, "You never get to any level of leadership where your race is not a factor. You don't want to be the first; you want to be the first of many."

Whether their husbands are denying illicit affairs or asking for forgiveness, the wives of politicians wrapped up in scandals always seem to stand — literally — by their men.Today, while I was watching New York Governor Eliot Spitzer briefly apologize to his family and the public for his involvement in a prostitution ring, I couldn't help but imagine his wife's humiliation. It always strikes me as cruel to make a woman who's been betrayed by infidelity, stand next to her husband for the sake of making him look better. Perhaps they're too in shock to protest serving as a political tool? Or maybe they're just used to it, and take it as part of life in the public eye.Cindy McCain did it after the Times's musings about her husband's ties to a lobbyist recently, and Larry Craig's wife stood by after her husband's bathroom run-in last summer.
