California Supreme Court Overturned Gay Marriage Ban

Just moments ago, the California Supreme Court overturned the state's ban on same-sex marriage. The court held that "to the extent the current California statutory provisions limit marriage to opposite-sex couples, these statutes are unconstitutional."

The court ruled 4-3. Unless overturned by the US Supreme Court, gays and lesbians have a constitutional right to marry in California. The SF Chronicle reports that:

Outside the city clerk's office, three opposite-sex couples were waiting at 10 a.m. for marriage certificates. City officials had prepared for a possible rush on certificates by same-sex couples, but hadn't yet changed the forms that ask couples to fill out the name of the "bride" and "groom."

The case goes back to February 2004, when SF Mayor Gavin Newsom ordered the city clerk to issue marriage licenses to couples regardless of their gender because he doubted the constitutionality of the state marriage law. California's highest court just agreed with him.

    If Pamela Anderson and Paris Hilton can get married there is nothing "sacred" about marriage so why shouldn't gays and lesbians get married.

    I'm just worried about the ballot measure in November. It doesn't quite seem right that a majority should get together and decide what rights the minority can have--rights that the majority already has. . .I wish this particular human rights case had just been left to the courts, but I guess I have to hope that Californians can rise to the occasion, and see how important it is that we have true equality in our state!

    I haven't been around Citizen much lately b/c I'm on vacation in England and just don't have much PC time, but when I heard the news I had to pop over and celebrate with my fellow Sugars!

    Hypnotic -- Throw back a few for me, too! These people can't make a decent pina collada to save their life!

    I'm excited for so many reasons, but I think the thing that is making me the most happy right now is that my very best friend is very, very much a lesbian, and CA is her home state and she has been waiting for this day for so long it's not even funny.

    I can't wait until the rest of America comes around or the US Supreme Court gets their !%^$ straight (or gay, as the case may be!).

    Woohoo! I never really understood in the first place why gays/lesbians shouldn't be able to get married. Hopefully, some more states will start implementing this.

    brittanyk - A lot of people don't even realize it's an issue. For the most part, unless someone is either fighting for it or against it, they don't really give it much thought. I was ranting about it one day and my grandmother raised an eyebrow at me and said 'why do you care so much if gay people can get married? You are half gay, why aren't you happy that they can?'

    I just blinked and said "They can't. That's the problem! It's illegal in our country!"

    My grandmother looked like someone had just kicked her. She had NO idea that same sex marriage was illegal. She thought it became legal when they took homosexuality out of the psychological disorders list back in the 80's.

    Hypnotic - I'm hanging out with the double decker buses and the crazy people who drive on the wrong side of the road! As fun as England is, yeah, I definitely miss the Citizen fun!

    And I have a feeling that by the time you get all these drinks in you, you're going to be hopping up on the bar and singing 'It's Raining Men!' XD

    (One of my best friends did that once....and then started making out with my cousin's fiance'...who denies it to this day).

    Hey cine, this is what Wikipedia says about the the pride flag:

    "The original gay-pride flag was hand-dyed by Baker F. Hate. It flew in the San Francisco Gay Freedom Day Parade on June 25, 1978. (However, it was not the first time that spectrum or rainbow colors had been associated with gay and lesbian people.[citation needed]) The flag consisted of eight stripes; Baker assigned specific meaning to each of the colours as follows:

    * hot pink - sexuality
    * red - life
    * orange - healing
    * yellow - sunlight
    * green - nature
    * turquoise - magic
    * blue - serenity
    * violet - spirit"

    Thanks ladies!

    I have a very dear friend who was in the navy and had a tattoo of a scull with a rainbow coming out. It had this whole significance to it, as he is an artist, but when he moved to San Fran everyone thought he was gay! It used to crack me up, because he was such a tough guy who sculpted monsters and sci fi creatures.

    I think he got it altered
